1. Acceptance of Terms

By accessing or using NailRush Live ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. You must be at least 18 years of age to use NailRush Live.

2. Eligibility & Age Requirement

You must be 18 years of age or older to create an account, purchase content, or become a creator on NailRush Live. By registering, you represent and warrant that you meet this age requirement. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect information from users under 18.

3. Creator Agreement

Creators ("Sellers") agree to the following:

  • You own or have rights to all content you upload.
  • NailRush Live retains a 15% commission on all sales. You receive 85%.
  • Payouts are processed via Stripe Connect. You must complete Stripe's verification to receive payments.
  • Content must be nail-industry related and comply with these Terms.
  • Creators offering booking services must hold a valid cosmetology/nail technician license in their jurisdiction and upload proof during onboarding.
  • You may not make unlicensed medical or health claims in your content.
  • NailRush Live may remove any content that violates these Terms without notice.

4. Prohibited Content

You may not upload, share, or sell content that:

  • Infringes on intellectual property rights of others
  • Is harassing, abusive, hateful, or discriminatory
  • Contains explicit adult content
  • Promotes illegal activities
  • Constitutes spam or misleading commercial practices

5. Refund Policy

All sales of digital products, courses, and video content are final and non-refundable.

Because digital content is delivered immediately upon purchase, we do not offer refunds. If you believe you were charged in error or experienced a technical issue preventing access, please contact us at support@nailrush.live within 7 days of purchase and we will investigate on a case-by-case basis.

For physical products, refunds may be available within 14 days of delivery if the item arrives damaged or is materially different from its description.

6. Intellectual Property

Creators retain ownership of their content. By uploading content to NailRush Live, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Platform.

7. DMCA & Copyright

We respect intellectual property rights. To submit a DMCA takedown request, contact us at dmca@nailrush.live with: (a) identification of the copyrighted work; (b) identification of the infringing content and its location; (c) your contact information; and (d) a statement of good faith belief that the use is unauthorized.

8. Limitation of Liability

NailRush Live is provided "as is." We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
